Dual-framework compliance: running HIPAA and GDPR controls in parallel

How to build a single control program that satisfies both HIPAA and GDPR—covering where the frameworks converge and where parallel procedures are unavoidable.

Running two compliance frameworks simultaneously feels like competing priorities—until you map them side by side. HIPAA governs protected health information for US-based covered entities. GDPR governs personal data of EU residents. If your SaaS product serves EU enterprise customers and handles health data, you are subject to both simultaneously. The security controls overlap more than they diverge. The operational pain is in the gaps: different breach clocks, different rights regimes, different consent logic.

Where HIPAA and GDPR agree

Both frameworks anchor their security requirements to risk analysis. HIPAA's Security Rule (45 CFR §164.308) mandates a documented risk analysis and a risk management plan. The mechanics differ—HIPAA specifies administrative, physical, and technical safeguard categories; GDPR does not—but the evidence auditors seek is similar: a risk assessment, a remediation register, and evidence of ongoing monitoring.

Access controls follow the same pattern. HIPAA's Minimum Necessary standard requires that workforce members access only the PHI their role requires. GDPR's data minimisation principle reaches the same conclusion through a different path. Encryption is a third convergence point. HIPAA treats it as an addressable implementation specification: implement it or document why you have not. Where they diverge—and why it matters

Breach notification timelines. HIPAA gives covered entities 60 days [source: https://iapp.org/news/a/gdpr-match-up-the-health-insurance-portability-and-accountability-act] from discovery to notify affected individuals and HHS. GDPR gives controllers 72 hours [source: https://iapp.org/news/a/gdpr-match-up-the-health-insurance-portability-and-accountability-act] from awareness to notify their supervisory authority. If a breach touches both US health data and EU personal data, the GDPR clock runs far faster. Your incident response runbook needs an explicit branch: detect breach → assess EU data involvement → start GDPR notification process → continue with HIPAA workflow. Two clocks, one incident. Data subject rights. GDPR grants EU residents the right to erasure, the right to data portability, and the right to restrict processing. HIPAA grants patients the right to access their records and request amendments—but not erasure. HIPAA requires retention of PHI for defined periods. If an EU resident who is also your patient submits a GDPR erasure request, you cannot simply comply: the HIPAA retention obligation overrides. Consent and legal basis. HIPAA uses a written authorisation model for non-treatment uses of PHI. GDPR requires one of six lawful bases. For special-category health data under GDPR Article 9, your legal basis may be explicit consent or the healthcare treatment exception, depending on your operating model. A HIPAA authorisation form is not a GDPR consent record. Maintain separate consent and legal-basis records for each framework.

Building a unified control map

  • Control owner—one person accountable, not two
  • Evidence artefact—policy document, log export, attestation record
  • Review cadence—quarterly, annual, or event-triggered
  • Frameworks satisfied—HIPAA only, GDPR only, or both

Governance structure

Do not run two separate compliance workstreams. A single privacy steering group, reviewing open items from both frameworks monthly, outperforms a HIPAA committee and a GDPR committee that rarely compare notes. At Series A–C stage, a single privacy lead holding both the HIPAA Privacy Officer and GDPR DPO roles is workable, provided there is no conflict of interest.

What auditors look for

EU supervisory authorities consistently focus enforcement on three findings: no documented legal basis for processing, breach notification failures, and failure to honour data subject rights. Weight your programme toward those three.

Both frameworks reward documented intent. A policy that clearly defines your approach—even where implementation is not yet complete—is better than undocumented practice that happens to be correct. Write the policies first. Build the evidence second.
